These Terms and Conditions set out the basis on which Rubbish Removal Lambeth provides waste and rubbish removal services to domestic and commercial customers. By booking a collection, using our services or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions. In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 "Company", "we", "us" and "our" mean Rubbish Removal Lambeth, the provider of rubbish removal and waste collection services.
1.2 "Customer", "you" and "your" mean the individual, business or organisation requesting or using our services.
1.3 "Services" means the rubbish removal, waste collection, clearance, loading, transportation and disposal services provided by the Company.
1.4 "Waste" or "Rubbish" means the items, materials or goods to be removed and disposed of as part of the Services, excluding any prohibited or hazardous items as defined in these Terms and Conditions.
1.5 "Booking" means any request by the Customer for Services, whether made by telephone, email, online or through any other communication channel accepted by the Company.
2.1 The Company provides rubbish removal and waste collection services within its operational area, including households, offices, retail premises, building sites and other locations agreed at the time of the Booking.
2.2 The Services typically include loading of waste onto our vehicle, transportation to a licensed waste facility, and disposal in accordance with applicable waste regulations.
2.3 The Company reserves the right to refuse to remove any items that it reasonably believes to be hazardous, illegal, unsafe to handle, or outside the scope of the agreed Services.
2.4 We do not provide deep cleaning, pest control, structural work, or any services that fall outside rubbish and waste removal unless expressly agreed in writing.
3.1 Bookings may be made by telephone, email, online form or any other method offered by the Company from time to time. The Customer must provide accurate and complete information about the waste to be collected, the access arrangements, and the collection address.
3.2 When you make a Booking, we may provide an initial estimate based on the information you supply. This estimate is not binding and may be adjusted once our team inspects the waste on site.
3.3 A Booking is only confirmed when the Company has accepted it and provided a confirmation, which may be in writing, by email, text message or verbally. The Company reserves the right to decline any Booking at its discretion.
3.4 The Customer must ensure that someone over the age of 18 is present at the collection address at the agreed time to grant access, provide instructions if needed, and make payment where required.
4.1 Any price indications provided prior to collection are estimates only, based on information supplied by the Customer. Final charges are typically determined by the actual volume, weight, type of waste, labour involved and access conditions.
4.2 Where feasible, the Company may provide a fixed quote prior to commencing work on site. Fixed quotes are based on a visual assessment of the waste and are subject to the accuracy of that assessment. If substantially different waste is presented, or if there are unforeseen access or safety issues, we may revise the quote before proceeding.
4.3 All prices are quoted in pounds sterling and may be subject to applicable taxes, duties or levies. Unless expressly stated otherwise, quoted prices are exclusive of such charges.
4.4 The Company reserves the right to change its rates, pricing structures and any promotional offers at any time. Changes will not affect Bookings that have already been confirmed with a fixed price, unless varied by mutual agreement.
5.1 Payment is due on completion of the Services on the day of collection, unless alternative credit terms have been agreed in writing in advance.
5.2 We may accept payment by cash, debit card, credit card, bank transfer or other payment methods as made available from time to time. We do not accept payment by cheque unless agreed in advance.
5.3 For business customers with agreed credit terms, invoices will be issued after completion of the Services. Payment must be made within the period stated on the invoice.
5.4 If payment is not received on time, the Company reserves the right to charge interest on the overdue amount at the statutory rate, together with any reasonable costs incurred in recovering the debt, including legal expenses.
5.5 The Customer shall not be entitled to withhold or set off any amount due to the Company against any claim or alleged claim against the Company.
6.1 The Customer must ensure that the waste to be removed is clearly identified and separated from any items that are not to be taken. The Company will not be liable for removing items that were not intended to be disposed of if they are reasonably presented as waste.
6.2 The Customer must provide safe and reasonable access to the waste and to the collection point. Any access issues or restrictions (such as limited parking, stairs, security gates or time limits) must be disclosed at the time of Booking.
6.3 The Customer is responsible for ensuring that the waste does not contain any prohibited or hazardous materials, unless these have been declared in advance and accepted in writing by the Company.
6.4 If our operatives believe that carrying out the Services would present a safety risk, cause damage to property, or breach local regulations, they may refuse to proceed or may amend the method of collection. Any additional time or equipment required may result in extra charges.
7.1 The Customer may cancel or reschedule a Booking by giving at least 24 hours' notice before the agreed collection time. Where sufficient notice is provided, no cancellation fee will normally be charged.
7.2 If a Booking is cancelled with less than 24 hours' notice, or if our team attends the site and is unable to carry out the Services due to circumstances within the Customer's control, the Company reserves the right to charge a missed collection fee or a proportion of the quoted price to cover its costs.
7.3 If our team is required to wait for access or instructions for more than a reasonable period, additional waiting time may be charged at our then-current hourly rate, subject to a minimum time charge.
7.4 In the event of adverse weather, traffic disruption, vehicle breakdown, staff illness or other circumstances beyond our reasonable control, we may need to reschedule your Booking. We will seek to notify you as soon as practicable and arrange an alternative time.
8.1 The Company handles general household and commercial waste, bulky items, garden waste, light construction and refurbishment waste, and similar non-hazardous materials.
8.2 Certain items may only be accepted by prior arrangement, and may incur additional costs, including but not limited to fridges and freezers, mattresses, tyres, electrical and electronic equipment, and items containing regulated substances.
8.3 The following categories of waste are generally prohibited and will not be removed unless expressly agreed in writing, in compliance with all applicable regulations and additional charges: asbestos, clinical or medical waste, biological or infectious materials, pressurised containers, explosives, flammable liquids, chemical or toxic waste, radioactive materials and any other hazardous substances.
8.4 If prohibited or undeclared hazardous items are found among the waste, the Company may refuse to remove them, may adjust the price to reflect the additional handling, or may cease work altogether. The Customer may be held liable for any regulatory penalties, clean-up costs or damages arising from the inclusion of such items.
9.1 The Company is committed to carrying out rubbish removal and waste collection in compliance with applicable UK waste management laws and regulations, including duties of care relating to handling, transport and disposal.
9.2 Collected waste is taken to licensed waste transfer stations or disposal facilities. Where possible and appropriate, we seek to promote recycling and responsible recovery of materials.
9.3 The Customer remains legally responsible for the nature and origin of the waste they present for collection and must not use our Services to dispose of illegal goods, stolen property or materials obtained through unlawful means.
9.4 Where required, and particularly for commercial customers, the Company may issue a waste transfer note or similar documentation. The Customer must retain such documents as part of its own legal record-keeping obligations.
10.1 The Company will exercise reasonable care and skill while providing the Services. However, minor scuffs, marks or superficial damage to walls, floors or doorways may occasionally occur when moving bulky items, and the Customer accepts this as a normal risk unless we have been expressly advised of delicate surfaces and reasonable precautions have been requested.
10.2 The Company shall not be liable for any loss or damage to items that have been clearly presented as waste, rubbish, or as items to be removed. It is the Customer's responsibility to ensure that no valuable or wanted items are left with the rubbish.
10.3 The Company shall not be liable for any indirect or consequential loss, loss of profits, loss of business opportunity, or loss of anticipated savings arising out of or in connection with the provision of the Services.
10.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
10.5 Subject to the paragraph above, the total aggregate liability of the Company for any claims arising out of or in connection with the Services shall not exceed the total amount paid or payable by the Customer for the specific Booking in relation to which the claim arises.
11.1 The Company maintains appropriate public liability and employer's liability insurance in respect of its operations, in accordance with legal requirements.
11.2 Evidence of insurance cover can be provided to commercial customers upon reasonable request.
12.1 The Customer is responsible for ensuring that suitable vehicle access and parking are available at or near the collection address. Any parking restrictions or permit requirements should be disclosed at the time of Booking.
12.2 Where parking fees, congestion charges or similar costs are incurred solely in connection with the provision of the Services, these may be added to the Customer's invoice.
12.3 The Company will not be liable for any penalties or fines arising from incorrect information supplied by the Customer regarding parking or access.
13.1 If you are dissatisfied with any aspect of our rubbish removal service, you should contact the Company as soon as possible, providing your Booking details and a clear description of the issue.
13.2 We will investigate complaints in a fair and timely manner and may request additional information or evidence. Where appropriate, we may offer a remedy such as a partial refund, a return visit, or other corrective action, at our discretion and in accordance with these Terms and Conditions.
14.1 The Company may collect and process personal data about Customers as necessary to arrange and provide the Services, manage Bookings, issue invoices and communicate with you.
14.2 We will handle personal data in accordance with applicable UK data protection laws and only retain it for as long as is reasonably necessary for the purposes for which it was collected or as required by law.
14.3 The Customer is responsible for ensuring that any personal information provided is accurate and up to date.
15.1 The Company may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated and will apply to future Bookings.
15.2 The version of the Terms and Conditions in force at the time of your Booking will apply to that Booking, unless a change is required by law or by a regulatory authority.
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The parties submit to the exclusive jurisdiction of the courts of England and Wales in relation to any dispute or claim arising from or connected with these Terms and Conditions or the provision of rubbish removal and waste collection services.
17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.
17.2 No waiver by the Company of any breach of these Terms and Conditions shall be considered a waiver of any subsequent breach of the same or any other provision.
17.3 These Terms and Conditions constitute the entire agreement between the Company and the Customer in relation to the Services, and supersede any previous agreements or understandings, whether written or oral.
